Terms & Conditions

Welcome to 3DcementStudio, a service operated under EverSilkSkin LLC (“Company,” “we,” “our,” or “us”). By accessing or using our website, services, or engaging in 3D facial scanning (the “Services”), you (“Client,” “you,” or “your”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use our Services.

1. Scope of Services

3DcementStudio provides artistic and cosmetic 3D scanning and modeling services for personal and commercial projects. Services may be performed online, at our studios, or at the Client’s home via independent third-party contractors. These Services are not medical procedures, do not provide medical advice, and should not be relied upon for diagnosis or treatment.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent and warrant that you meet these requirements.

3. Independent Contractor Scanning Services

  • Contractor Status: 3DcementStudio uses independent third-party contractors (“Contractors”) to perform in-home 3D facial scans. Contractors are not employees, agents, or representatives of EverSilkSkin.

  • Liability: EverSilkSkin disclaims liability for Contractor acts or omissions beyond its protocols. Contractors cannot bind EverSilkSkin to any commitments.

  • Risk Acceptance: By consenting to a scan, the Client acknowledges that use of independent services carries inherent risks, and agrees that EverSilkSkin is not responsible for any incidental or indirect damages, except where caused by gross negligence or willful misconduct.

4. Client Consent & Opt-Out Rights

  • Consent Requirement: No scan may occur without documented consent. Consent may be provided via text message confirmation, written form, or in-person agreement.

  • Withdrawal of Consent: Clients may withdraw consent at any time before, during, or after a scan by notifying EverSilkSkin or the Contractor. Upon withdrawal, the scan will cease immediately, and any data collected will be securely deleted.

  • Acknowledgment: By giving consent, the Client understands how their scan data will be collected, transmitted, stored, and used.

5. Data Collection, Storage & Confidentiality

  • Sensitive Data: Facial scans are biometric information. EverSilkSkin collects only data necessary for creating the 3D model.

  • Transmission: Contractors must transmit data securely to EverSilkSkin and may not keep, copy, or use data for any other purpose.

  • Storage: EverSilkSkin stores biometric data using industry-standard security safeguards and retains it only as long as reasonably necessary.

  • No Sale or Sharing: EverSilkSkin will never sell, lease, or share biometric data with third parties without explicit Client consent.

6. Contractor Conduct & Safety

  • Identification: Contractors must provide proof of identity and behave professionally.

  • Safe Conduct: Contractors may not engage in unsafe, illegal, or inappropriate conduct during home visits.

  • Equipment: Contractors will use only approved scanning equipment and methods.

  • Hazards: Contractors will stop or postpone scans if unsafe conditions exist (e.g., aggressive pets, hazardous environments).

7. Client Responsibilities for Home Visits

  • Safe Environment: Client must provide a safe, clean, and hazard-free environment.

  • Disclosure: Client must inform EverSilkSkin of any risks, hazards, or restrictions (e.g., pets, fragile items, allergies).

  • Cooperation: Client must follow reasonable Contractor instructions during the visit to ensure safety.

8. Payments, Refunds & Cancellations

  • Payment: Fees must be paid at booking or as otherwise specified.

  • Refunds: Refunds are available only in cases of service cancellation by EverSilkSkin or as required by law.

  • Rescheduling: Clients may reschedule home visits with at least 48 hours’ notice.

9. Intellectual Property

All 3D models, scans, and related works created by EverSilkSkin remain the intellectual property of EverSilkSkin until full payment is received. After payment, Clients may use the deliverables for personal, non-commercial purposes unless otherwise agreed in writing.

10. Limitation of Liability

  • EverSilkSkin is not responsible for indirect, incidental, or consequential damages arising from Services, including loss of profits, goodwill, or data.

  • Total liability is limited to the amount paid for the Services.

  • Services are provided “as is” without warranty of accuracy, fitness, or completeness.

11. Indemnification & Waiver

The Client agrees to indemnify and hold harmless EverSilkSkin, its affiliates, officers, employees, and Contractors from any claims, damages, or liabilities arising from:

  1. The Client’s use of Services.

  2. Conditions at the Client’s premises during a home visit.

  3. Third-party claims relating to the scan or resulting data.

The Client waives all claims against EverSilkSkin except in cases of gross negligence or willful misconduct.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California and applicable federal law. Any disputes will be resolved exclusively in the state or federal courts located in California.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
